Welcome to usmetalsusa.com (the “Website”) and to the US Metals (USM) Precious Metals Recovery Program (PMRP). The USM PMRP is operated by US METALS, LLC. Your relationship with Us will be governed by these USM PMRP Terms and Conditions.

1. Overview of the PMRP. We purchase items made of precious metals (the “Items”) for refining. In these Program Terms, we use the word “Metals” to refer to platinum, silver, palladium, and gold. The amount paid for your Items is based upon two things: (1) the total weight and purity or karat grade (pure precious metal content) of the Metals contained in your Items, and (2) the market value of the Metals according to the current London Fix (the price set during two daily bidding sessions in London).USM reserves the right to decline to purchase your Items for any reason at our sole discretion, including without limitation, declining to purchase those Items that contain insignificant amounts of the Metals or are otherwise of no value. If we don’t purchase your Items, we’ll return them to you at no cost upon request. If no request is made within 10 business days, we will recycle all the items. As We discuss more fully below, you can communicate with us about the Program through either email or by telephone.
2.  Requirements to Participate in the PMRP. You must be at least eighteen (18) years of age in order to sell Items containing Precious Metals to Us. By shipping your Items to USM, you are representing that you are the legal owner of them, that you have the authority to sell them, and that you accept the PMRP Terms. Selling on behalf of others is not permitted, either as an agent or as a representative of any other person or company.You agree to provide USM with all information requested concerning you or your items. USM will, for example, require that you Fill out the compliance form which will require you to provide your driver’s license number or passport number. Upon receival of the AML form shipping label will be provided for your package. If you choose to self-ship the items we’ll share the shipping address.  USM reserves the right to decline to purchase your Items if We do not receive such information.
3. Summary of Our Procedures. You may register for the PMRP through the Website or by calling Customer Service at 855-925-5340. For registration through the Website, you should fill out this form (general public) or fill out this form (companies).
4. Shipping. You can request a shipping label and insurance for up to $1000.00 through USM, however if you feel the package being shipped is valued at more than $1000.00, please contact customer service. YOU do have the right to self-ship and self-insure your packages.
5. Evaluation and offers. After USM receives your Items and evaluates them, USM will send you a response by email within two (2) business days (excluding holidays). If USM decides your Items are appropriate for purchase, we will make an offer (the “Offer”) to you, either by email or telephone conversation, to purchase the Items based upon the PM London Gold Fix on the business day your package is received. As part of the Offer, you may request pictures of your items being unpacked and weighed in.
6. Accepting the Offer. Your acceptance of the Offer will be by email or a telephone conversation. If you accept the Offer (an “Acceptance”), you’ll be paid the accepted sum by check, e-check, or bank wire ($35.00 fee applies). We’ll mail the check within two (2) business days from the date of your Acceptance. By cashing, endorsing or depositing the check, you’ll also be confirming your Acceptance of our Offer and your consent to these Program Terms. If you choose an E-Check as a method of payment you’ll receive it to your email address within seconds.
7. Rejecting the Offer. You’ll also have the option to reject the Offer (a “Rejection”). In that event, USM will ship the items back to you within two (2) business days. You will incur no shipping charges. USM will insure the package with your Items up to $1000.00. You the client retains the right to self-ship and insure your return package; if you feel the insurance is not high enough for your package.
8. If You Don’t Respond. If USM does not receive a response to our Offer within two (2) business days, we will send a reminder to the provided email address. If USM still has not received a response from you, an additional (2) business days will be granted. If no response is received withing a total of four (4) business days from the initial Offer, the Offer will be withdrawn. ALL items will be archived for an additional (2) month(s). If USM is unable to locate or receive a response after the (2) months, the archived items will be recycled.
9. Other processing information. You can check on the status of your Items by going to www.usmetalsusa.com or by calling Customer Service at 855-925-5340. We’ll respond to all inquiries you have about your package within two (2) business days (excluding holidays). The hours of our customer service department are Monday-Friday 9AM-5PM, Pacific Time.If you don’t have an email address or if you prefer to communicate by phone, we will notify you of the Offer and receive your Acceptance or Rejection, as outlined in these Program Terms, by telephone. We will finalize the processing of your Items upon the Acceptance of Our Offer. By cashing, endorsing or depositing the check, you’re reconfirming your acceptance of the “offer” and consent to the above Program Terms.
10. Proper Shipment. We reserve the right to reject delivery of ANY package which appears to be damaged, opened, or tampered with. Any such package will be returned to you at no charge. USM will not accept any liability for any such items, delivery will be refused. Please see Shipping T&C.
11. Insurance Limitations on Shipped Items. If you choose to use the prepaid shipping label, your items will be insured with the carrier for a maximum value of One thousand dollars ($1,000). It’s your responsibility to ensure the carrier has electronically scanned the prepaid label/package into its tracking system. This ensures you and the client that the package has been accepted. It is also your responsibility to retain a receipt from the carrier. If you think your Items are worth more than $1000.00, We recommend that you contact USM for further instructions. Items that hold precious metals value will be returned to you, only these items will be insured for $1000.00. If the returned items are non-precious, there will be no insurance on the package. USM will use the sole discretion on value, carrier, and receipt verification of the returned package. You agree that your sole remedy for losses that may occur during shipment is the sole responsibility of you, the client, all claim processes will be done by you the client directly with the carrier. USM will not be held responsible nor be involved in the processing of said claims.
12. Changes and Amendments. WE RESERVE THE RIGHT TO CHANGE AND AMEND THESE PROGRAM TERMS FROM TIME TO TIME WITHOUT PRIOR NOTICE TO YOU. SUCH CHANGES AND AMENDMENTS SHALL BECOME EFFECTIVE IMMEDIATELY UPON THE POSTING OF THE SAME TO THE WEBSITE. YOU ARE RESPONSIBLE FOR REVIEWING THE WEBSITE PERIODICALLY FOR ANY MODIFICATION TO THIS AGREEMENT THAT MAY AFFECT YOUR RIGHTS OR OBLIGATIONS HEREUNDER. YOUR CONTINUED ACCESS AND USE OF THE WEBSITE OR REQUEST FOR A SHIPPING LABEL AFTER THE POSTING OF CHANGES AND AMENDMENTS SHALL BE DEEMED TO CONSTITUTE YOUR ACCEPTANCE OF ANY REVISIONS OR ADDITIONS.
13. Content on the Website.  The text, images, logos, graphics, photographs, descriptions, illustrations, data, and other material on the Website, as well as the selection, assembly, and management thereof, are herein collectively referred to as the “Content.” We reserve the right to discontinue, correct, delete, update, or change any Content, product specifications, and prices at any time without notice to you.
14. Indemnity. You agree to defend, indemnify and hold harmless USM and its affiliates, each Service Provider, and their respective employees, officers, directors, agents, and representatives from any claim, losses, damages, liabilities, costs, or demand, including reasonable attorney’s fees, arising out of or relating to your breach of these PMRP Terms and/or your participation in the PMRP; provided, however, this indemnity shall not apply to any claims, losses, damages, liabilities, costs or demands resulting from the gross negligence or willful misconduct of USM or any Service Provider. The foregoing indemnification obligation shall survive termination of these PMRP Terms and Conditions and the conclusion of the purchase of any of your Items under the PMRP.
15. Entire Agreement. These PMRP Terms constitute the entire agreement between you and USM concerning the Program, and they supersede all previous written or oral agreements between you and USM concerning the Program.
16. Applicable Law. These PMRP Terms and the rights and obligations arising out of or relating to the Program shall be governed and construed according to the laws of the State of Nevada, without regard to its conflicts or choice of law provisions. The exclusive venue for any litigation arising out of, or related to participation in the PMRP, these PMRP Terms and Conditions, or use of the Website shall be in the United States District Court for Las Vegas, NV County of Clark unless that Court lacks subject matter jurisdiction in which case the courts of general jurisdiction of Clark County, Nevada shall be the exclusive forum and venue for any such action. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Program must be filed within one (1) year after such claim or cause of action arose or be forever barred.
17. General. No waiver by Us of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. If any provision of these PMRP Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the terms herein and shall not affect the validity and enforceability of other provisions of these PMRP Terms. The headings and captions herein are intended for convenience only and shall in no way affect the interpretation of these PMRP Terms.US Metals, LLC and its Service Providers shall not be liable for any nonperformance or delay in performance caused by any act beyond its reasonable control, including but not limited to acts or omissions of third parties, epidemics, pandemics, unavailability of supplies, equipment failure, war, strikes, lock-outs, fire, flood, or any other act of God, any law, regulation, ordinance (or changes in any law, regulation or ordinance), or other act or order of any court, government, or governmental agency, or delays, unavailability, errors, or other failures of the Internet or other data networks.
